These Terms of Service ("Terms") govern your access to and use of the Proselyn online store and your purchases from it. Proselyn is a brand operated by DVAI LLC, a Tennessee limited liability company ("Proselyn," "we," "us," "our"). By using our site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old, or use the site under the supervision of a parent or guardian who agrees to these Terms, and you must provide accurate, complete information when you order.

2. Products, made-to-order nature & variations

All items are printed and made to order. You acknowledge that, due to the printing process and differences in screens and devices, slight variations in color, print placement, and fabric are normal and are not defects. Product images are for illustration. Returns and remedies are governed by our Return & Refund Policy, which is incorporated into these Terms.

3. Pricing, errors & orders

Prices are in U.S. dollars and may change at any time. We strive for accuracy but do not warrant that product descriptions, pricing, or other content are error-free. We reserve the right to refuse, correct, limit, or cancel any order — including after an order is placed — due to pricing or description errors, suspected fraud, or product availability, and to refund you in such cases.

4. Intellectual property

All content on this site — including the Proselyn name and logo, designs, artwork, graphics, text, and the look and feel of the store — is owned by DVAI LLC or its licensors and is protected by intellectual-property laws. Our designs are original, trope- and reading-culture-based works and are not affiliated with, endorsed by, or licensed from any book, author, film, or fandom. You may not copy, reproduce, resell, or create derivative works from our content or products without our prior written permission. Any unauthorized use terminates the limited permission to use our site.

5. Acceptable use

You agree not to use the site unlawfully, to interfere with its operation or security, to scrape or harvest data, or to infringe the rights of others.

6. Disclaimer of warranties

The site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the limited extent of the defect/wrong-item remedy stated in our Return & Refund Policy and any rights that cannot be excluded under applicable law. We do not warrant that the site will be uninterrupted, secure, or error-free.

7. Limitation of liability

To the maximum extent permitted by law, DVAI LLC and its owners, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the site or any product, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to a product or your use of the site will not exceed the amount you actually paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless DVAI LLC and its owners, officers, and employees from any claims, damages, losses, and reasonable legal fees arising out of your misuse of the site, your violation of these Terms, or your violation of any law or the rights of a third party.

9. Third-party links & services

Our site and checkout rely on third-party services (such as Shopify, payment processors, and our fulfillment partner) and may link to third-party sites. We are not responsible for the content, policies, or practices of those third parties.

10. Governing law & venue

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute not subject to the resolution process below will be the state and federal courts located in Davidson County, Tennessee, and you consent to their personal jurisdiction.

11. Dispute resolution & class-action waiver

Before filing any claim, you agree to first contact us at support@proselyn.com and attempt in good faith to resolve the dispute informally for at least 30 days. To the extent permitted by law, you and DVAI LLC agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective" date shows the current version, and your continued use of the site after changes are posted constitutes acceptance of the updated Terms.

13. Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Return & Refund, Shipping, and Privacy policies, are the entire agreement between you and us regarding the site and your purchases.

SMS Program Terms

Proselyn (operated by DVAI LLC) offers a recurring automated text message program for marketing and order-related messages (the "SMS Program"). By enrolling via our website, checkout, or any other opt-in method, you consent to receive recurring automated marketing and transactional text messages from Proselyn at the phone number you provided, including messages sent by autodialer. Consent is not a condition of any purchase.

Message frequency varies (for example, cart reminders, order updates, and occasional promotions). Message and data rates may apply depending on your mobile plan; check with your wireless carrier. Carriers are not liable for delayed or undelivered messages.

Opting out: You can cancel the SMS Program at any time by replying STOP to any message. After you send STOP, we will send one final message to confirm that you have been unsubscribed. To re-join, sign up again through any of our opt-in methods.
